The Business Name, GST and PAYG registration service provided by Zibia Pty Ltd (we, us or our) to you through the Site.

Using the Website or Services means an agreement to abide by the following Terms. If don’t agree with all the Terms, you must not access or otherwise use our Service or this Site.

2. Your obligations and rights in respect of the Website

You are permitted to view, download and print any Website content, including text, images, information, graphics, software, or any materials on the Website (Content) that are expressly permitted to be downloaded or printed using a laptop, personal computer, tablet, smart phone, PDA or any other similar device, to use in a non-commercial and personal capacity for the purpose of using our Services.

You agree not to:

- Use any of the Website Content for commercial purposes;
- Translate, reverse engineer, adapt or alter any of the Website software;
- License, publish or sell the Content for use on another website;
- Modify or edit the Content in any way;
- Add links to the Website from any other website before receiving our express written permission;

gstregistry.org does not provide legal services or accounting services as part of the Service. We neither provide, nor claim to provide, specific legal, accounting or financial advice. Any advice we do provide will be general in nature.

Although our team includes start-up experts and accountants, we do not provide, or claim to provide, financial or legal advice. The Services do not include legal or accounting services.

All information supplied by you when using our online registration service must be complete and accurate to the best of your knowledge. Your use of our online applications service is taken as an agreement that any information you supply is complete, accurate and up-to-date. Supplying the ATO or ASIC with false or misleading information is an offence. It is your responsibility to inform us of any changes to your information, which you can do by contacting us at info@gstregistry.org.

We reserve the right to request that you verify your identity in accordance with these Terms by providing us with a form of identification at any time.
In the event that you provide us with incorrect information, neither we (nor any of our authorized representatives) will be liable for any charges, damages or loss that arise in connection with that information.

The aim of this Website is to provide you with clear and succinct information. We are not liable if you misinterpret such information. If you require clarification on any of our information, please contact us

Neither we nor our authorized representatives will be legally responsible for any costs resulting from you supplying incorrect information.
It is our intention to start work on your GST registration application as soon as we receive it. Therefore, you agree to authorize us (or our nominated representatives) to act on your behalf as your registered BAS agent in your GST application.

We will communicate on your behalf via both telephone and electronic communications with the ATO in the processing of your application.

In some cases, it will not be not possible for us to arrange for your GST application to be processed immediately by the ATO via our electronic system. In such cases, we will either apply over the telephone or lodge a paper application. If we are not able to complete the registration, we will refund your money. On the rare occasions the ATO Registration systems are not functioning, we will aim to process your registration as soon as the systems are working again. As the performance of the ATO Registration systems is out of our control, delays due to failing systems fall out of our guarantee of 24-hour registration. You will not be eligible for a refund in such cases.

5. Rejections

The ATO may reject your application for a number of reasons. These reasons include (but are not limited to):

- information supplied is not an exact match for information the ATO holds on record
-  the ATO has determined you are not eligible to apply for GST registration
-  the ATO is experiencing processing issues, such as system maintenance or downtime

If the ATO rejects your registration, we will contact the ATO and attempt to resolve any issues on your behalf. We will inform you of the reason(s) for the rejection and suggest solutions where possible.

6. Pre-requisites

In order to use our GST registration service, you must fulfill all the following criteria:

-  you are, or will be, carrying on a business in Australia
-  you do not pay interest, royalties or dividends to non-residents
-  you are a resident of Australia for tax purposes.

We will complete every application under the assumption that applicants fulfill all the above criteria.

7. Fees, refunds and charges

Fees

You must pay all fees and charges owed to us upon submitting the GST registration application form, without deduction, unless otherwise specified in the Terms. All relevant fees and charges must be paid before your GST registration application can be successfully submitted.

Fees and charges are listed in Australian Dollars (AUD) unless explicitly otherwise stated.

Refunds

We will not offer refunds of fees paid in relation to our Services, to the extent permitted by law, except in the following circumstances:

You advise us you want to withdraw your GST application before the registration process has been started. In such cases, we may offer a full refund, minus our Administration Charge. Our services, however, are automated and operate in real-time in coordination with the relevant government agency. As a result, Services usually commence immediately after you submit your application and pay the associated fee.

We will provide refunds in such circumstances entirely at our discretion:

You submitted an GST application which has been put on hold without being issued and you decide to withdraw the application. In this case, and at our discretion, we may offer you with partial refund totaling 50% of the GST registration fee.

If we receive a refund of any charges you have paid from ASIC, we will inform you right away and process a refund to your designated account.

We may use any sum we owe to you to off-set any amounts you owe to us in connection with these Terms.

8. Disputes and chargebacks

Disputes and chargebacks filed with your bank or/and with your credit card company will be considered as a breach of the Terms and Conditions. As such, we will no longer be representing you as your TAX agent and will immediately proceed to revoke and terminate any GST, Business Name or PAYG registration filed by us on your behalf should this scenario occur.

9. Accuracy of information

This Website and its Content are provided on an “as is” basis. We endeavor to ensure all Website information is complete, accurate, and fully up to date. However, we do not make any guarantees in respect of the reliability, completeness, currency, or accuracy of the Content distributed or accessed via, contained on, linked to, or downloaded from or this Website.

10. Website Availability

We try at all times to ensure the Website, including its Content, performance, features and functionality, is continuously available, but we do not claim nor guarantee that access will be free of errors, timely or uninterrupted. Nor do we represent that the Website or its related server is virus- or bug-free, or free of other interference or harmful applications. It is your responsibility to carry out adequate virus checks and to ensure enough procedures are in place to fulfil your own requirements.
In the event of system failure, maintenance, repairs or any other reasons beyond our control affecting the Website, we may suspend your Website access without prior notice.

Where any rights, warranties or conditions are implied by law and cannot be excluded, we limit our liability for breach of, or other act contrary to, that implied right, warranty or condition, either under the provision of section 68A of the Trade Practices Act 1974 (Cth) or otherwise to the extent permitted by law.

Subject to the provisions of previous clauses, and despite any implication which arises from any of these Terms’ provisions, we are not and will not be liable to you in tort (including negligence), in contract, under any statute (to the extent permitted by law) or otherwise for, or in respect of, any loss (direct or indirect), costs or damages that you incur or are liable for in connection with your use of the Site, the Content or the Service, including, but not limited to, if caused by a computer virus, including any virus passed to your computer or any third-party computer from this Site, or loss of online connection to this Site, the Content or the Service, or interruption to your access to this Site, the Content or the Service.

Any reliance placed on this Site or the Content by you will be at your own risk. You indemnify us against any damage or loss suffered by you as a result of your reliance upon this Site or the Content.

The laws of the State of New South Wales, Australia governs these Terms. You submit to the non-exclusive jurisdiction of that State’s courts.

If any part of these Terms is declared unenforceable or invalid, for any reason, the validity of the remaining parts of the Terms will be unaffected. The remaining parts will remain in full effect, and the Terms will be taken as if the unenforceable or invalid part has been eliminated.

These Terms supersede all previous agreements, understandings, negotiations and representations in relation to the subject matter of the Terms. These Terms record the entire agreement between you and us.

When you use the GST register service, you consent to us contacting you via SMS or email for the purposes of completing your transaction. You also consent to us and our affiliates contacting you for marketing purposes. To opt out from our marketing communications at any time, you should respond to the communication with Unsubscribe or STOP.
